1. Introduction
Welcome to Catalyst Coast. These Terms of Service ("Terms") govern your use of the services provided by Catalyst Coast ("we," "us," "our") and our website, catalystcoast.com. By engaging our services or using our website, you agree to comply with and be bound by the following terms and conditions. Please read these Terms carefully. If you do not agree with these Terms, you should not use our services or website.
2. Services Provided
Catalyst Coast provides digital marketing services, including but not limited to:
Google Business Profile Optimization
Reputation Management
Missed Call Text-Back Automation
Lead Generation Funnels
Other marketing services as outlined in service agreements or proposals. Details of the specific services provided to you will be outlined in a proposal, scope of work, or contract agreed upon between you and Catalyst Coast.
3. Payment Terms
3.1 Pricing and Payment Structure
Our pricing model includes options for both monthly payments and discounted multi-month plans:
Monthly Payments: Customers may choose to pay one month at a time for our services. 3-Month or 6-Month Plans: Customers can pay upfront for 3 months or 6 months to receive a lower monthly cost overall. This discount is applied as a "bonus" for committing to a longer-term.
3.2 Satisfaction Guarantee
At Catalyst Coast, we stand behind the quality of our services. We offer a satisfaction guarantee under the following conditions:
The client must communicate any dissatisfaction with the service prior to the end of their paid term (either 3 or 6 months) so we can resolve the issue. The guarantee applies only if the client has been adequately utilizing the services provided (e.g., responding to review requests, providing necessary access, following through with recommended strategies). If these conditions are met, we will either refund the remaining portion of the prepaid term or continue to provide services until the issues are resolved, at our discretion.
3.3 Accepted Methods of Payment
Payments are processed via Stripe. We accept:
Credit and Debit Cards (Visa, Mastercard, American Express, etc.) Apple Pay and Google PayBank Transfers (ACH) All payments are securely processed through Stripe’s platform.
3.4 Billing and Payment Schedule
One-Month Plan: Payment is due at the start of each month. 3-Month and 6-Month Plans: Full payment for the selected term is due upfront. Clients will receive an invoice that covers the full period at the time of signing up.
3.5 Late Payments
If payment is not received by the due date, we reserve the right to suspend services until payment is made in full. Reinstatement of services may be subject to a late payment fee of 3% of the outstanding amount.
4. Cancellations and Refunds
4.1 Cancellation Policy
You may cancel your services at any time by providing [number of days, e.g., 30 days] written notice to Catalyst Coast. Cancellations will take effect at the end of the current billing cycle (for one-month plans) or at the end of the prepaid term (for 3-month or 6-month plans).
4.2 Refund Policy
Due to the nature of our services, refunds are only available under our satisfaction guarantee as described in Section 3.2. There are no refunds for services already rendered unless agreed upon under this guarantee.
5. Client Responsibilities
To ensure the success of our services, you agree to:
Provide accurate and timely information as requested by Catalyst Coast.Respond promptly to communications and requests for approval.Provide necessary access to tools, platforms, and resources (e.g., Google Business Profile, CRM access) for us to perform our services effectively.
Failure to fulfill your responsibilities may delay the execution of our services and could affect the results.
6. Intellectual Property
6.1 Ownership
All materials, content, and work created by Catalyst Coast during the course of service provision remain the intellectual property of Catalyst Coast until payment is made in full. Once full payment is received, you will have ownership of the work created specifically for you.
6.2 License to Use
You are granted a non-exclusive, non-transferable license to use the content and materials created for you for your business purposes only. You may not distribute, resell, or otherwise use these materials outside the scope of the original agreement without prior written consent from Catalyst Coast.
7. Service Modifications
We reserve the right to modify or discontinue any service, either temporarily or permanently, with or without notice, if deemed necessary due to technical or business considerations. We will make reasonable efforts to provide notice of significant changes.
8. Limitation of Liability
Catalyst Coast shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services or website. In no event shall our total liability to you exceed the amount you have paid for the services provided by Catalyst Coast over the last three (3) months prior to the occurrence of any claim.
9. Warranties and Guarantees
9.1 No Guarantees on Results
While we strive to deliver results based on agreed-upon goals, we cannot guarantee specific outcomes, such as a particular increase in leads, sales, or search engine rankings. The success of marketing and SEO campaigns depends on various factors, including market conditions, client cooperation, and other external variables.
9.2 No Warranty
Our services are provided “as is” and without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
10. Confidentiality
We agree to keep any confidential information shared by you, including business plans, proprietary strategies, and any personal data, in strict confidence. Likewise, you agree to keep any methods, processes, or pricing information provided by Catalyst Coast confidential.
11. Termination of Services
We reserve the right to terminate services immediately and without notice if:
You breach any terms of this agreement. Payment for services is consistently delayed or unpaid. You engage in illegal or unethical practices in connection with the services we provide.
Upon termination, you will be invoiced for any services provided up to the date of termination.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.
13. Amendments
